My Read

At the current asking price, I think this property is worth taking a look at. You have approximately 1.31 acres of industrial-zoned land that is already being used for truck, vehicle, equipment, and outside storage.

The current use is also what makes this property interesting. The IX1 zoning does not allow truck or equipment storage as a primary use by right, but because the property is already being used this way, there is a possibility that the existing use is legal nonconforming and may be able to continue.

If the City confirms that the current use is legal nonconforming and can continue with the next owner, I think that could add a lot of value to the property. There are not a lot of sites where you can park trucks and equipment outdoors, so being able to continue the existing use could be a major benefit.

The IX1 zoning also allows certain lighter industrial uses, including small-scale production, small-scale distribution, research and development, product repair and maintenance, and some contractor uses. I would still want to confirm exactly how the City classifies your business before assuming the property will work for your use.

What I Like

The biggest thing I like about this property is the current use. It is already being used for truck, vehicle, equipment, and outside storage, which can be difficult to find in this part of Pomona.

For the right buyer, the existing use could be one of the biggest benefits here. If the City confirms that the use can continue, you may be able to use the property for something that would not otherwise be permitted under the current zoning.

The property also has a fairly direct route to the 60 Freeway. Going south on Reservoir Street takes you directly toward the freeway. It is still approximately 2.5 miles away, so it is not right off the freeway, but the route itself is straightforward.

I also like that the property is being sold primarily for land value. For an owner-user that needs more yard than building, this could make more sense than buying a traditional industrial building where most of the value is tied up in the improvements.

What to Plan For

This property will require some additional due diligence because of the current use.

The first thing I would want to confirm is whether the existing truck and equipment storage is a legal nonconforming use and whether the next owner can continue using the property the same way. I would not assume that just because trucks and equipment are currently being stored there, a new buyer automatically has the right to continue that use.

If I were buying the property, I would want written confirmation from the City before removing contingencies. I would also want the City to confirm exactly what can continue on the property, including the amount of outside storage, number of vehicles, and type of equipment being stored.

I would also be careful about any interruption in the existing use during the sale. If the property is relying on legal nonconforming rights, you want to make sure those rights are not lost before the new owner takes over.

Environmental due diligence will also be important. A lender will typically require a Phase I Environmental Site Assessment, and because there appear to have been semi trucks, vehicles, and other equipment parked on the property for an extended period of time, I would also be prepared for the possibility of a Phase II ESA if the Phase I identifies anything that requires additional investigation.

The freeway access is another thing to consider. Reservoir Street provides a direct route south toward the 60 Freeway, but the property is still approximately 2.5 miles away. If you are running multiple trucks in and out of the property every day, that additional distance will add some travel time.

Best Fit

I think the best fit for this property is a user that wants to continue using it similar to the way it is being used today for equipment storage, work vehicle parking, semi-truck parking, or another similar outside storage use, assuming the City confirms that the existing use can continue.

That is where I think the real opportunity is with this property.

If you are looking to develop the property or change the use, I would take a closer look at the zoning before moving forward. There may be other properties that are better suited for your intended use and would not require a CUP or additional City approvals that could add time and cost to the project.

For me, this property comes down to whether the existing use can be preserved. If it can, I think the property becomes much more interesting. If it cannot, then I would look at the property based on what the IX1 zoning allows today rather than what is currently happening on the site.
